Workshop/Training title:
Unlawful
Harassment and Discrimination
The Employer's Responsibility to Identify, Correct and Prevent. |
This module is designed as a
1/2 Day training . The
intended audience would include Company Executives, Supervisors,
Managers, Shift Leaders and Lead Workers.
Why is Training Important?
A recent Equal Employment Opportunity Commission
enforcement guidance report spelled out specifically the obligation
management has in regards to a workplace free of harassment. The report
titled Vicarious Liability For Unlawful Harassment by Supervisors
indicates high degree of responsibility and accountability Companies
have through their management and supervisory staff.
 | If general, if a company knew or should have known about
harassment in the workplace and did little or nothing to correct and
prevent future harassment, they likely would suffer huge losses. The
key is to identify, correct, and
prevent harassment. That takes training! |
 | Companies that have ongoing Training, Policies, and Work Rules
regarding harassment, and exercise discipline for infractions, can
mount an affirmative defense against a charge of Sexual Harassment.
This can limit or remove entirely any employer liability. Companies
that do not are substantially vulnerable to large settlements
or judgments. |
 | If a Supervisor either implies or is explicit about trading a
sexual favor for a condition of employment, the employer cannot mount
an affirmative defense. The company is liable for damages. The
harasser could also be liable. |
 | IMPORTANT, the EEOC's definition of a supervisor is
different from the traditional meaning. If a person has scheduling or
assignment authority over another, or has input in performance
ratings, they may be considered as a supervisor in the eyes of the
EEOC. This could include lead workers, shift leaders, foremen etc.
This is significant because SUPERVISORS ARE HELD
AT A HIGHER STANDARD. SUPERVISORY INVOLVEMENT IN HARASSMENT IS
EXTREMELY COSTLY AND HARD, IF NOT IMPOSSIBLE TO DEFEND.

Note: A certificate will be prepared for each
participant's Personnel File, outlining the content of the training.
This will provide proof the employer provided training.
The fee for the 1/2 day training for up to 20 participants is
$575.00 plus mileage expenses. An additional fee of 5.00 for each participant will be charged
to cover the cost of study materials. Please call for quote if + 20
participants.
In-house training is currently available for Northeastern Iowa,
Western Wisconsin and Southeastern Minnesota.
